Please read these policies carefully before purchasing any service or booking a session. By purchasing a service from Barracuda BJJ, you agree to the terms outlined below.

CANCELLATION & RESCHEDULING

Notice requirement

All cancellations and reschedule requests must be submitted at least 24 hours before the scheduled session start time. You can cancel or reschedule directly via the link in your Calendly confirmation email.

Late cancellations & no-shows

  • Cancellation with 24+ hours notice: Session is returned to your package and can be rescheduled at no cost.
  • Cancellation with less than 24 hours notice: The session is counted as used and cannot be recovered.
  • No-show (no notice given): The session is counted as used and cannot be recovered.

Coach cancellations

In the unlikely event that Coach Tim needs to cancel a session, you will be notified as early as possible and the session will be fully returned to your package or rescheduled at a time of your choosing — no session is lost.

Monthly subscriptions

Sessions within a monthly subscription that are cancelled with less than 24 hours notice or not attended count as used. Unused sessions do not roll over to the following month.

How to cancel: Use the cancellation link in your Calendly booking confirmation email. If you are unable to access this, contact Coach Tim directly at timothacker@gmail.com or +31 6 21 37 46 40 before your session time.

Sessions not used within the validity period are forfeited without refund, unless an extension has been agreed in writing with Coach Tim.

Medical extensions

If you are unable to complete your sessions due to injury or medical reasons, a package freeze of up to 4 weeks may be granted upon presentation of a doctor's note or medical certificate. The validity period resumes when the freeze ends. Extensions beyond 4 weeks are considered on a case-by-case basis.

To request a medical extension, contact Coach Tim at timothacker@gmail.com with supporting documentation.

Subscription pausing

Monthly subscriptions may be paused once per 6-month period for a maximum of 4 weeks due to travel, illness, or other personal circumstances. Pause requests must be submitted at least 7 days in advance. Billing resumes automatically when the pause period ends.

PAYMENT & REFUNDS

Payment processing

All payments are processed securely via Stripe. Barracuda BJJ does not store your card or payment details. By completing a purchase you agree to Stripe's terms of service.

EU cooling-off period

Under EU consumer law, you have the right to cancel a purchase within 14 days of the date of purchase and receive a full refund, provided no sessions have been used. If you have used one or more sessions within the 14-day period, a partial refund will be issued for unused sessions minus a €35 administration fee.

Refunds after 14 days

After the 14-day cooling-off period, no refunds are issued on session packages. In exceptional circumstances (e.g. serious illness or injury), a credit toward future services may be offered at Coach Tim's discretion.

Subscription cancellations

  • Monthly subscriptions require 30 days written notice to cancel.
  • A minimum commitment of 1 full month applies to all subscriptions.
  • Cancellations submitted mid-cycle will take effect at the end of the following billing month.
  • No refund is issued for partially used subscription months.

Refund requests

To request a refund within the cooling-off period, contact timothacker@gmail.com stating your name, purchase date, and reason. Refunds are processed within 5–10 business days to the original payment method.

HEALTH & MEDICAL DISCLAIMER

Health declaration

By booking a session with Barracuda BJJ, you confirm that you are medically fit to participate in physical exercise and that you are not aware of any condition that would make exercise inadvisable without medical supervision.

PAR-Q & intake information

All new clients are required to complete a Physical Activity Readiness Questionnaire (PAR-Q) prior to their first session. This is provided during the intake/introduction session or via the Calendly booking form. Providing accurate and complete health information is your responsibility.

Disclosure of medical conditions

You must inform Coach Tim of any injuries, medical conditions, or physical limitations before commencing training. This includes but is not limited to: cardiovascular conditions, musculoskeletal injuries, recent surgery, chronic pain, or pregnancy. Failure to disclose relevant health information releases Barracuda BJJ from liability for any resulting harm.

Not a substitute for medical advice

Coaching and programming provided by Barracuda BJJ is for fitness and performance purposes only and does not constitute medical advice, diagnosis, or treatment. While Coach Tim holds an MSc in physiotherapy (candidate), the coaching relationship is not a clinical one. If you have a medical concern, consult a qualified healthcare professional.

Liability limitation

Participation in personal training involves inherent physical risk. Barracuda BJJ takes all reasonable precautions to ensure your safety, however Barracuda BJJ cannot be held liable for injury, loss, or damage arising from participation in sessions, provided reasonable care has been taken by the coach. You participate at your own risk.

If your health status changes at any point during your coaching programme — including new injuries, illness, or medical diagnoses — please inform Coach Tim before your next session so your programme can be adjusted accordingly.

CODE OF CONDUCT

Expected behaviour

  • Arrive on time and prepared for your session.
  • Treat Coach Tim and any shared training facilities with respect.
  • Communicate openly about how you are feeling physically and mentally before and during sessions.
  • Follow the guidance and programming provided — modifications will always be offered where needed.
  • Maintain appropriate hygiene standards for in-person sessions.

Professional boundaries

All coaching relationships are strictly professional. Coach Tim reserves the right to terminate a coaching relationship at any time if a client behaves in a disrespectful, threatening, or inappropriate manner. In such cases, a refund for unused sessions will be issued.

Right to refuse service

Barracuda BJJ reserves the right to refuse or discontinue service to any client whose behaviour is deemed inappropriate, or whose health status presents a risk that falls outside the scope of personal training coaching.

PRIVACY POLICY

Who we are

Barracuda BJJ is operated by Tim Hacker, based in The Netherlands. For privacy-related enquiries, contact: timothacker@gmail.com

What data we collect

  • Contact information: name, email address, phone number
  • Health information: PAR-Q responses, injury history, medical conditions disclosed during coaching
  • Payment information: processed and stored by Stripe — Barracuda BJJ does not store card details
  • Booking information: session dates and times via Calendly
  • Communication records: emails and WhatsApp messages related to coaching

How we use your data

  • To deliver coaching services and manage your programme
  • To process payments and manage bookings
  • To communicate with you about sessions, scheduling, and progress
  • To ensure your safety during training

Your data is never sold, shared, or used for marketing purposes without your explicit consent.

Legal basis for processing (GDPR)

  • Contract performance: processing your name, email, and payment data to deliver the service you purchased
  • Explicit consent: processing health and medical data (PAR-Q) — you provide this consent during your intake session
  • Legitimate interest: maintaining communication records related to your coaching

Data retention

Personal and health data is retained for 2 years after the end of the coaching relationship, after which it is securely deleted. Payment records are retained for 7 years in accordance with Dutch tax law.

Your rights under GDPR

As a data subject under GDPR, you have the right to:

  • Access the personal data held about you
  • Rectify inaccurate or incomplete data
  • Erasure of your data ("right to be forgotten")
  • Restrict processing of your data
  • Data portability — receive your data in a portable format
  • Object to processing based on legitimate interest
  • Withdraw consent for health data processing at any time

Complaints

If you believe your data has been handled incorrectly, you have the right to lodge a complaint with the Dutch Data Protection Authority: Autoriteit Persoonsgegevens at autoriteitpersoonsgegevens.nl
